In recent years, the issue of the relationship between intellectual property rights and human rights has become an active dispute at the international level. The reason for this is that both intellectual property and human rights have become the dominant discourse of our time. The current research is an attempt to participate in the scholarly debate in the above dispute and to realistically assess the relationship between intellectual property rights and human rights. The topic chosen by this research has three important features: novelty, interdisciplinary nature, and breadth. Although intellectual property rights and human rights are not new issues on their own, examining their relationship is a new issue.

در چند سال اخیر، مسئله ارتباط حقوق مالکیت فکری و حقوق بشر به مناقشه‌ای فعال در سطح بین‌المللی بدل شده است. علت این امر آن است که مالکیت فکری و حقوق بشر، هر دو، گفتمان مسلط عصر ما شده‌اند. تحقیق حاضر تلاشی است در مشارکت عالمانه در مناقشه فوق و سنجش واقع‌بینانه نسبت و رابطه حقوق مالکیت فکری و حقوق بشر. موضوعی که این تحقیق برگزیده است سه ویژگی مهم دارد: تازگی، میان رشته‌ای بودن و گستردگی. هرچند حقوق مالکیت فکری و حقوق بشر هر کدام به تنهایی موضوع تازه‌ای نیستند ولی بررسی ارتباط آن‌ها‌، مسئله نوپیدایی است.
